Thomas Cook faces legal action after mum injured by ‘obese woman’

A holidaymaker is suing Thomas Cook after she said she nearly died after being hit by an “obese woman” at the bottom of a waterslide.

Solicitors acting for Jemma Joslyn, a health care assistant from East Sussex, claim she was seriously injured while on a two-week holiday at Liberty Lykia Hotel in Turkey last September.

Thomas Cook said its UK-based welfare team and in-resort team had been in touch with Joslyn on several occasions following the accident.

The operator also arranged for her parents to fly to Turkey to be with Joslyn.

The mother-of-two had to be rushed to hospital for surgery after being crushed by another holidaymaker who had crashed into her on the slide.

She was suffering with internal bleeding, liver and kidney damage, five cracked ribs and fluid on the right lung.

Now Joslyn is taking legal action against Thomas Cook, after claiming that there were no safety precautions at the hotel to monitor who was coming down the slide at the hotel’s water park.

Travel litigation solicitor Magdalena Knez, from law firm Slater and Gordon, is representing Joslyn’s legal case.

She said: “Thomas Cook have confirmed they have received our correspondence and are looking into the case.

“We are waiting on a further response and are hopeful we will have a successful outcome for Jemma who has been through a very traumatic experience.”

The lawyer added: “My client could have spent her life needing serious medical attention due to the fact that the swimming pool slide was not operated with the appropriate safety measures.

“A simple thing, such as having a lifeguard on duty could have stopped this incident happening.”
