BAA will seek a second judicial review of the Competition Commission’s decision to force a sale of Stansted and either Edinburgh or Glasgow airports.
The airport operator will file a fresh legal challenge at the Competition Appeal Tribunal today (Friday) in its latest attempt to overturn the regulator’s decision, made in 2009, that BAA must offload Stansted and one of the Scottish airports.
In a statement, BAA said: “The challenge relates to the Competition Commission’s consideration of whether there have been material changes of circumstances since its original 2009 decision such that it is not necessary or appropriate to require BAA to divest Stansted.”
While the latest appeal relates only to Stansted, it may delay the disposal of Edinburgh or Glasgow as the Commission linked the two sales. It ordered BAA to sell Stansted first.
The Commission confirmed its original decision in July, following an appeal, giving BAA three months to begin the sale process.
