Torremolinos hotel bug leaves Thomson facing fresh legal action

Holidaymakers visiting the hotel at the centre of a £2.5 million compensation payout by Thomson and Thomas Cook have reported a further illness outbreak.

In February more than 790 guests of the Beach Club Hotel in Torremolinos successfully took legal action against the operators after contracting the Norovirus stomach bug between 2000 and 2002.

Now Irwin Mitchell, the law firm which acted for the holidaymakers, has been approached by other customers who want to take action against Thomson.

The latest to come forward are Charles and Ann Fish, from south London, who travelled to the Beach Club Hotel in April 2008 with Thomson Holidays. Both said they experienced severe diarrhoea, vomiting and abdominal cramps within a few days of arriving.

The couple had to delay their flight back to the UK after Mr Fish was admitted to hospital and placed on a drip.

Head of the travel law team at Irwin Mitchell, Clive Garner, said: “Since 2002, there has been an alarming pattern of reports of illness and poor hygiene conditions at this hotel. All reasonable action should have been taken by the hotel management and tour operators to ensure the hotel was safe for all of its guests.”

A spokeswoman from Thomson said: “We can confirm that a small number of cases of sickness were reported at the Beach Club Hotel, Torremolinos in March and April of this year.

“We would like to clarify that the percentage of reported cases during these months has never exceeded, or reached, 1% of in-house figures. An investigation found no fault with the property’s food or water standards.”
