JMC fails to get ruling overturned

JMC has failed in its attempt to overturn a legal ruling
that it had failed in its responsibility to a passenger by giving them a 29
inch seat pitch.

The operator lost an appeal at Chester County Court against
a decision that the seat pitch given to Brian Horan, 57, from Cheshire, was too
small.

A statement issued by JMC said: “JMC Holidays Ltd will
consider carefully the need to lodge an appeal against the decision announced
at Chester County Court.

“The company continues to believe that the interpretation of
the tour operator’s responsibilities for its supplier in this case was
incorrect and JMC was not in breach of its contract with Mr Horan.”
