ABTA warns of breaching Data Protection Act

ABTA is to send out warnings to members about unsolicited faxes and mail after one operator breached the new Data Protection Act.

Head of legal services Riccardo Nardi said under the 1998 Data Protection Act it is illegal for companies to send out faxes or mail to people who have registered with the Facsimile Preference Service and the Mail Preference Service that they do not want to receive them.

Nardi plans to meet the FPS and MPS to establish what members obligations are before sending out a circular.

He urged members to keep their customer databases updated to check that clients had not signed up with the FPS and MPS since.

New legislation is expected to follow to cover unsolicited e-mails.
