Fine may keep Air Miles in line


The growth of Air Miles is one of the factors reducing the number of holidays booked through retailers.



The text of last month’s European Commission ruling about agents’ incentivecommission seems to leave Air Miles also open to complaint.



The paragraph on loyalty discount reads:”It is well established community law that a dominant supplier cannot give incentives to its customers and distributors to be loyal to its customers, so foreclosing the market from the dominant firms competitors.”



It could be that the Air Miles scheme is also in breach of article 82 EC. It might take years but perhaps another £6.8m fine will see BA back peddle on Air Miles’ huge expansion.
